Terms and Conditions
ASSUMPTION OF RISK, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
- Sunrise Lodge strives to do everything possible to ensure the safety of its guests. In consideration for Sunrise Lodge’s services, I, on behalf of myself, and my minor child (if applicable), and my heirs and/or representatives, voluntarily enter into this Assumption of Risk, Waiver of Liability and Indemnity Agreement (“Agreement”). I hereby voluntarily agree to waive, release, indemnify, and hold harmless Sunrise Lodge and its officers, directors, agents, employees, volunteers, representatives and community partners from any and all liability, causes of action, or claims for any injuries or damages as a result of my participation in any Sunrise Lodge activity.
- I understand this Agreement does not waive any claims resulting from gross negligence, willful, reckless or wanton misconduct by Sunrise Lodge. I also understand that Sunrise Lodge is not responsible for the acts of third parties under this Agreement.
- I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including serious injuries or death, that may be sustained by me (or my minor child), as a result of my (or my minor child’s) participation in any Sunrise Lodge activity.
- The undersigned hereby waives any and all claims or actions that may arise against Sunrise Lodge, its owners, directors, employees, or volunteers as a result of any such injury to any such person. Such risks include, but are not limited to:
- a. Injuries or death resulting from the failure or negligent misuse, by me or others, of the facilitators or equipment of Sunrise Lodge.
- b. Injuries caused from slips, trips, falls, or other such accidents that occur while using the facilities or which may be caused by other persons’ use of the facilities or equipment of Sunrise Lodge.
- c. Injuries resulting from participating in and/or using equipment in connection with the activities run by or sponsored by Sunrise Lodge.
The guest freely and voluntarily assumes complete personal responsibility for these risks and for the injuries that might occur as a result of these risks, even if such injuries occur in a manner that is not foreseeable at the time this agreement is signed.
By agreeing below, the guest acknowledges that he or she has read the agreement thoroughly and understands and accepts these terms herein. By agreeing below, the undersigned represents and warrants that they have the authority to agree to this written agreement on behalf of all individuals whose legal rights this agreement contemplates to waive. In the event a portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
